A short-term rental is any residential property, including a single-family dwelling or a unit in a condominium, cooperative, or time-share, that is rented wholly or partly  for a fee for a period not longer than 30 consecutive days.

State Requirements

Texas doesn’t have any statewide regulations for short-term rentals. These regulations have been left up to local counties and cities to create their own laws. 

There are two state taxes that are required and paying these taxes requires registration through the Texas Comptroller Office.

Do I Need to Register My Short-term rental?

In order to pay the taxes required by the state of Texas, short-term rental owners need to register with the Texas Comptroller Office and complete Form AP-102, Hotel Occupancy Tax Questionnaire
